My goal in presenting the information available on Australian Retirement Villages is to help my readers decide if living in a retirement village or a retirement village with assisted living options is for them. If you decide that either of these options is for you, then hopefully I can provide you with a source of information for you to first find a retirement village in a region or specific town and then locate a home of your choice.

Neil has many years of experience managing retirement villages, permanent residential parks now known as residential land lease communities, caravan parks, serviced apartments and motels. I have assisted the senior members of our community for many years.

My extensive experience means that I understand and appreciate what you are going through when you decide it is time to consider moving into a retirement village or taking that step to move into assisted living where others will cook your meals, do your cleaning and be on hand in case of a medical episode. I have endeavoured to present this information in a format and a language that is easy to understand. Useful links have also been provided to make it easier for you to obtain more detailed information should you require it. I gain a great deal of personal satisfaction from helping others, particularly the mature members of our community.

What is a retirement village?

A retirement village is a residential housing community or complex generally for people over the age of 55 years. It consists of housing units or villas that can be purchased or rented depending on the business model the owner and operator of the village has established in the village. A retirement village may offer a range of different accommodation options. These can be Independent Living Units known as ILU’s, Serviced Apartments or Assisted Living Units or a combination of these. In some cases, a retirement village can also offer high level aged care. Most retirement villages offer a range of community facilities which are managed by the village owner or operator. Some of the facilities offered may include:

– Community Centre with or without licensed bar facilities,
– Regular planned social activities and outings,
– In Home Care and assisted living services,
– Swimming pools,
– Lawn and Indoor Bowls,
– Golf courses,
– Regular bus and shopping trips,
– Gated community for security and peace of mind, and
– 24 hour emergency assistance.

Many retirement villages will have a residents’ committee and sub-committees. These committees have a very important role in the overall management of the village. Residents will elect the committee at an Annual General Meeting (AGM). The committee will hold regular meetings with both the residents and the village management. The purpose of this is so that residents can raise matters they want discussed with the village owner and to help find solutions to any problems that may have arisen. These meetings are also a great forum for discussing improvements to the facilities provided and capital works or improvements.

It is my experience that an active residents committee who liaise and meet regularly with the village manager contribute greatly to the overall happiness and satisfaction of the residents. They are an important part of village life.

Residents pay a monthly maintenance or service fee which is determined when the village operator presents the annual budget at the Annual General Meeting for approval by the residents. (for more information please refer to the Article “Monthly Charges and Fees”)

Generally, the repairs and maintenance of the unit such as plumbing and electrical as well as appliances is paid for through the monthly fees. If an appliance that is provided by the village is uneconomical to be repaired, for example a dishwasher, it will be replaced by the village owners.

With retirement villages, if you are purchasing the right to occupy a unit and not renting the unit, you will pay an ingoing contribution which is the purchase price. You will sign a very detailed contract which sets out all the terms and conditions relating to your occupation of the unit. It will also set out what happens when it comes time to sell the unit including the Deferred Management Fees (DMF) or Exit Fees and how these are calculated.

Village owners can and do have differing business models. This will determine what happens when it comes time to sell your unit and what fees are paid by the outgoing resident.

The contract sets out the rights and obligations of both the resident and owner and operator of the village.

It is recommended that you obtain good legal advice from a legal firm who are very experienced in the Retirement Village contracts so that when you sign the contract you know that you are well aware of your obligations and that your rights and interests are protected.

What is the difference between a Retirement Village and Land Lease Communities or Lifestyle Villages?

There are a number main differences between a retirement village and a residential land lease community which includes lifestyle village, lifestyle resort and a manufactured housing estate.

The first main difference is that there is different and specific legislation that both the owner / operator and residents must comply with.

For example: in New South Wales retirement villages must comply with The Retirement Villages Act 1999 (NSW), the Retirement Villages Regulation 2017 (NSW) and the Retirement Villages Amendment Act 2018 (NSW) which commenced on 1st July 2019. Residential Parks in NSW are governed the Residential (Land Lease) Communities Act 2013 (http://classic.austlii.edu.au/au/legis/nsw/consol_act/rlca2013320/) and the Residential (Land Lease) Communities Regulations 2015 (https://classic.austlii.edu.au/au/legis/nsw/consol_reg/rlcr2015411/)

The second main difference is the type of tenure or right to occupy that is granted to the resident. (Include link to “Leasing Arrangements”.

Retirement Villages

Generally you are granted a 99 year lease on your chosen unit. You do not actually own the unit. You will have purchase costs which include Stamp Duty, Legal Fees, generally selling fees, strata fees if applicable, and depending on your contract you may have to contribute to renovation costs. You may also be entitled to a share of the capital gain.

Some retirement villages offer serviced apartments and a higher level of care to cater for those residents who require the assisted living.

Land Lease Communities including Lifestyle Villages and Lifestyle Resorts

are generally residential communities for the over 50 over 55s who live independently and will organise their own in home services if needed. You purchase and own the home. It is yours and is a willable asset. It is the resident’s responsibility to maintain the home and the site. The resident has the right to occupy the site under a Residential Site Agreement in accordance with the Act and Regulations.

Unlike retirement villages, no stamp duty is payable on the purchase of the home or the site agreement.

The land lease communities will offer a range of facilities similar to that you will find in retirement villages. You pay a weekly rental fee or site fee to cover the running and management costs of the community, the facilities, council rates etc.

The site fees, as with retirement villages, will vary according to the location of the community, the facilities provided and the services offered on site.

As suggested by the title of “Lifestyle Villages” and “Lifestyle Resorts” these will generally offer a greater variety of facilities more in line of what you would envisage that you would find in a “Resort”.

The residents also typically tend to be more independent and on average are about 9 years younger than those living in other retirement communities.

What is the difference between an Independent Living Unit (ILU), a Serviced Apartment, and an Aged Care Facility?

Independent Living Units or “Villas”, offer a variety of accommodation types. These may consist of:

  • Complexes,
  • Stand-alone residences,
  • Semi-detached buildings, or
  • Terraces houses.



They are generally one or two bedroom and will vary in size. Some villages do have larger three bedroom units avaialble. Independent Living Units (ILU’s) are usually located in retirement village-type community with related benefits and facilities. These units are suitable for people who are more independent, active, and who can take care of themselves and attend to the usual everyday duties of cooking, cleaning, shopping etc.

A Serviced Apartment is an ideal choice for an active and independent person who wants or needs a easier lifestyle with fewer daily chores. If you don’t want to spend your time doing shopping, cooking, or household chores, then a serviced apartment may be the right choice for you. Services may include:

  • Three daily meals, cleaning, and laundry services,
  • Staff who are on-site and available 24 hours,
  • Communical facilities, events, and social activities.



Serviced Apartments are usually located within a secure building and may consist of units that range in size from a studio apartment to two-bedroom units. Similar to a hotel, these supported assisted living units may have a basic kitchenette and some may have balconies and secure parking for those who are still driving.

Residents can make use of external providers for additional in-home care services above those which are provided by the retirement village.

An Aged Care Facility or Home is ideal for those in our community who are longer able to live independently and need ongoing personal care and / or health care to enable them to live a full and meaningful life. This to enable them to remain as active as they can be taking into account their personal circumstances.

These facilities that provide the a higher level of care can sometimes be referred to as Nursing Homes. The resident’s room may or may not include the furnishings and bedding, you will need to clarify this with this with the provider.

All meals, laundry, nursing care, personal care, and social activities are provided in an aged care home. The home also manages and maintains the premises as part of the service offering.

What levels of support and services are offered in a Retirement Village?

The range of services and support will differ across different retirement villages. You should always consult with the sales person and manager as well as requesting a brochure or information pack to be sure what services are available at village of your choice.

Generally speaking, some of the most common facilities may include:

– Swimming Pools,
– Gardens,
– Walking Paths,
– Communal dining halls and lounges,
– Social events such as card games, happy hours, indoor bowls, or trivia.

Some retirement villages may also have additional facilities like:

– On-Site Shops such as hair-dressers, or movie theaters
– Golf Courses
– Medical needs can also be catered for with on-site clinics and medical consultation services, as well as weekly visits by specialised professionals such as physiotherapists.

The services offered usually extend to:

– Internal and external maintenance and repairs of your unit,
– Maintenance of the grounds and common areas,
– Rubbish removal, water, and council land rates,
– Building insurance and the general upkeep of all infrastructure.

There is also typically a 24-hour emergency call service available that will offer immediate assistance in an emergency.

What are Deferred Management Fees (DMF) or Exit Fees and why are they charged?

Deferred Management Fees

Understanding Deferred Management Fees which are also known as Exit Fees can be difficult and complicated, so it is recommended that you consult your legal advisor and have them explain the fees to you. It is also a good idea to have a family member or your Power of Attorney https://www.tag.nsw.gov.au/wills/make-power-attorney/what-power-attorney with you so that you both fully understand DMF’s.<br.
 I hope that this article will help you understand the fundamentals of Deferred Management Fees and Exit Fees.

When you leave a retirement village and your unit is sold, in most cases you will need to pay the DMF that is applicable as calculated in accordance with the terms and conditions of the contract you signed when you purchased the unit. This could be on either the re-sale value of the unit or the original purchase price. The Deferred Management Fee may or may not include a share in the capital gain as well as a contribution towards the renovation or re-instatement costs of the unit. You should clarify this so that you know your entitlements and responsibilities.

The DMF or Exit Fee is usually a percentage of either the original purchase price or resale price and can be between 25% and 40%. This percentage will vary depending on the operator. What is also taken into consideration is the number of years you have lived in the retirement village.

Some village operators charge a flat percentage of the sale price for a maximum number of years.

For Example, they might charge a DMF of 3.5 per cent for a maximum of ten years. This means that if you leave after say five years, the DMF is 17.5%. If you reside there for 10 or more years you will 35% of the resale price.

The number of years that the Deferred Management Fees is calculated over and the maximum percentage rate varies, so you need to check this with the village operator.

The owner or operator of the village should be able to provide you with some good examples of the applicable Deferred Management Fees.

This fee is not payable until the unit is re-sold and settled.

An example of deferred management

Example 1. The unit is re-sold at a price of $400,000 after the resident has lived in the unit for 4 years. DMF is calculated at 3.5% per annum to a maximum of 35%.

$400,000 at 3.5% is $14,000 per annum multiplied by 4 years means the DMF is $56,000.

If the resident has been in the unit for 10 years or more the DMF is $140,000 being $14,000 multiplied by 10.

Example 2. The unit is re-sold at a price of $400,000 after the resident has lived in the unit for 4 years. DMF is calculated at 4.0% per annum to a maximum of 40%.

$400,000 at 4.0% is $16,000 per annum multiplied by 4 years means the DMF is $64,000.

If the resident has been in the unit for 10 years or more the DMF is $160,000 being $16,000 multiplied by 10.

The Exit Fees are paid to the operators of the retirement village and serve as a source of income that can be used to improve the village and provide funding for capital works and improvements for the benefit of residents.

It is important to remember that going into a retirement village is more about living a certain lifestyle and receiving certain services than it is about receiving financial returns on a property or making a profit.

What does the ongoing monthly fee cover and are these fees increased or fixed?

Depending on the type of retirement village and the property you live in, as well as the facilities and services being offered, the ongoing costs will vary depending on:

– The type of retirement village
– The property you live in
– Location, area and local facilities
– The services and facilities on offer

These monthly (or weekly) recurrent charges or fees are based on the day to day running or operating costs of the entire village. These include maintenance of the village, facilities and units, salaries for staff, administration, compliance with obligations stipulated in legislation, council rates and insurance. It also includes the provision of services, facilities and activities.

In retirement villages that operate under a strata, company or community scheme, there will also be fees or levies to the owner corporation or community association.

Recurrent fees are not fixed. They are generally set for each twelve month period in accordance with the approved budget and are subject to review at regular intervals. In practice this is usually annually. The contract provided by the village will detail how ongoing fees are calculated and how they are increased.

This information can usually be found under the “variation of recurrent charges” heading in your brochure and it will specify if the fees increase by using a fixed formula or some other method of calculation.

Fixed formulas are generally based on the same rate as the Consumer Price Index or the age pension. Some villages also take individual circumstances into account when calculating the increases.

Increases usually take place once every 12 months, but if this is not specified in the contract then the operator must provide at least 14 days’ written notice of any increases.

Recurring fees are also based on the annual budget that has been decided on for the village and it is divided among the residents. Depending on the village policy, residents living in larger units, or residents living with spouses may need to pay a higher recurrent fee. The budget may also change every year, with plans and allowances made for extra services and new facilities.

A full budget is compulsory for all retirement villages and it lets residents know how their recurring fees will be allocated and spent. The village operators must prepare the budget every year and provide residents with a copy of all the proposals at least two months before the start of each financial year.

The budget must state the reasons for any changes in expenses and all residents must consent to the budget and the changes proposed by a majority vote before it may be enacted.

In some villages, there are sometimes extra services available at an additional cost which may include such as things as cleaning, laundry, and meals. However, these are optional services and are not a part of the standard recurring fees. Always make sure that such optional services are correctly stipulated in the contract with their ‘applicable supplementary fees’.

What information do I need to know or consider before I purchase a unit in a Retirement Village?

There are many factors that will need to be taken into account before deciding on purchasing Retirement Village property.

The first and most important consideration will be the location. Choosing a retirement village in the right area will have many impacts on your current and future lifestyle.

You will have to think about factors such as:

– Do you stay close to where you are now or move to a different area?
– Is a complete change of scenery, such as settling near the coast or away from a busy city important
– Do you want to remain close to family and friends?
– Is the retirement village in an accessible, centrally located base?

Once you have determined where you want to be located and what you want from that location, then you can start looking at the retirement communities available in that area.

The next thing that you will need to consider is the retirement villages themselves and the options that they offer.

– Will you be living alone or with a spouse?
– What kind of space do you need to live comfortably?
– If you like gardening will the property have one that you can tend to?

You will need to look at the sizes of the units available, and the amenities that they provide.

You also need to carefully assess the services and facilities on offer. If you are an avid swimmer, does the village have a swimming pool? If you like socialising does the village provide group activities?

You will also need to assess the retirement village costs for these services and determine if they fit your budget. Lifestyle resort style retirement villages can often incur more expensive monthly fees as part of their services and facilities.

You need to know if you can afford it. Make sure you seek expert legal and financial advice, ask questions, and ensure you understand all the implications before finalising a decision.

Lastly, you will need to think about the future and your, or your spouse’s physical health and abilities. Are you looking for retirement villages with aged care facilities? Or do you need a place that provides you with a more independent living environment?

You can also look at the options between Independent Living Units, Serviced Apartments, or Aged Care homes and decide which retirement living model best suits your needs.

Many new over 55 living developments now also offer a combination of these models. These allow you to move from one type of lifestyle to another without leaving the village. So even if your care needs to change you can still stay in the same community.

Finally, you need to carefully consider what is essential and what you’re willing to compromise on. You also need to be clear about what things you definitely don’t want and avoid those options from the start.

When is the right time for me to consider moving into a Retirement Village?

Some people tend to start thinking about their retirement when they reach their 50s and as they age, start to consider where they should live and if they should downsize to either a retirement village or a residential land lease community. Since both these options are for over 50 and over 55’s, this means that you will have a few years to search around for the right retirement living community and plan your transition.

As everyone is different, and at their own individual and unique point in life, the age at which people decide to move into a village will vary from person to person. There is no perfect or set age to move into a retirement village, it is wholly your own decision to make whenever you feel that you are ready for the next step in life.

The truth is that retirement is a very personal choice, and you have to make a decision that suits you and your own specific circumstances and requirements. Try and remember that retirement doesn’t mean that your life is over, and a retirement village is not the last resort or final option. It is a new chapter in your life.

Also keep in mind that a retirement village can offer you a vibrant social environment, with plenty of activities that can keep you busy, and the opportunity to meet new people and share new experiences. At the same time, you will be in a community that offers you safety and peace of mind, knowing that your different levels of healthcare needs will be taken care of as they change over the years.

Planning will however be absolutely essential. You need to take the time to do your research and select the right village that will suit you, your needs, and the type of retirement lifestyle you can see yourself living in comfortably.

However, you will find that the sooner you make your decision, the sooner you can enjoy your new retirement community. You will no longer have the usual daily stresses that accompany owning your own home. This includes things like the regular upkeep of the premises, monthly mortgage charges, and the safety of your property when you leave it to go on holiday.

Be prepared, as many happy residents have found, they lead fulfilled, meaningful, busy, social and active lifestyle once they have made the move into a retirement village.

What type of title or ownership options are there when buying a Retirement Village unit?

The different types of title or ownership which include :

– Leasehold
– Strata or Community Title
– Loan or Licence Arrangement
– Company Title
– Rental Schemes

Leasehold

    • Generally, the village operator will grant a 99 year Lease over a specific unit granting you exclusive rights to occupy and live in the unit. The lease is registered on the title deed at the Land Registry Service (NSW). The resident is then considered a “Registered Interest Holder”.
    • In this type of tenure, when you purchase a unit in a retirement community, you become the full owner of the premises. You also automatically become a member of the owners’ corporation or community association.
    • You will need to enter into a service contract with the operator and you will have to pay them levies on a monthly or quarterly basis to cover the costs of managing and maintaining the common property areas.
    • Once you decide to sell the property you may do so at any price you want but under certain contract terms. You may also have to pay the operator a share of any capital gains as well as exit fees.

Loan or Licence Arrangement

    • These are generally offered by Not For Profit organisations where the retirement village is owned by a charitable organisation or religious organisation. This means that you do not have a registered interest in the unit and that you are allowed to reside in the unit in accordance with the terms and conditions of the lease.
    • You may, depending on the village owners requirements, need to pay an entry payment known as in-going contribution or an interest-free loan.

Company Title Schemes

    • Although not a common model, there are a small number of privately managed villages that operate under Company Title. What this means is that the entire village is owned by a company.
    • When you buy a unit, you are actually buying shares at market value. These shares allow you to rightfully occupy the premises but you will be required to comply with the company’s constitution and policies.
    • As a shareholder, you have a voice in appointing the Board of Directors responsible for operating the village. When you decide to leave you will have the same selling rights as that of a strata scheme.

Rental Schemes

    • A few villages provide rental units to retirees which are similar to renting a property through a real estate agent or private person. Generally you would be required to pay a rental bond.
    • You will be required to pay a weekly rental. You could also need to pay for water and electricity if these are metered separately.
    • There are no Deferred Management Fees or Exit Fees payable with a rental unit.

Am I able to keep my pet it when I move into my Retirement Village unit?

Retirement villages with independent living units

Pets can be an integral part of our lives and are well known for aiding in a persons overall health and well being particularly as we age.

Unfortunately, there is no standard rule or regulation that governs pet ownership in retirement villages. Each village will have its own policies and rules regarding pets. Just as pet owners want to be considered and catered for, so do others who may not be so fond of animals.

The village operators have to take into consideration the potential damage a pet could do, to either the unit or the surrounding common areas and how pet behaviour can affect other residents. One could have a robust and active dog that loves to go digging up the lawn or not be well controlled by its owner and create a hazard for others.

Pets can cause considerable damage to the inside of a unit if not properly trained and controlled. Does the resident have the capacity to care properly for the pet? Who has the liability to repair any damaged caused, or if the pet injures a resident or visitor to the village.

So when researching a future retirement community it is vital that you ask for a copy of the village’s rules handbook, pet policy or code of conduct. If there is no mention of pet allowances in these documents, ask the village administrators or operators directly. Pet ownership may be included as part of the contract stipulations.

Can I have visitors or guests stay with me including my grandchildren as they are a big part of my life?

Visitors Staying Overnight

Family is important, there is no denying that. Residents are certainly allowed to have visitors on a regular basis. But many villages will have policies and regulations in place surrounding the number of guests and how long they’re allowed to stay.

In the case of aged care or assisted living facilities, the rules regarding visitors and visiting hours may be similar or even stricter to that of a hospital.

These rules are there to protect the operators and the units by adhering to government regulations regarding occupancy levels. The regulations are also there to protect everyone being treated fairly and equally.

Every village resident has the right to live in an environment that is free from harassment, and without any interference to their peace, comfort, and privacy.

Can Visitors Use The Facilities?

Village residents pay a recurring fee that allows them to use the services and facilities. Allowing non-residents to enjoy those same amenities is up to village operator and how they determine this policy. In some retirement villages the community rules might allow visitors to use the facilities as long as the visitor is under the supervision of and in company with the resident.

For example, visitors can use the swimming pool as long as the resident is with them. The pool is not there as a free alternative to paying for entry into a public pool.

Many villages where there is a dining room will allow the resident to invite a visitor to dine with them. Generally all that needs to be done is to book the visitor in for the meal and pay the required fee which is usually very modest for the standard of meals provided.

It is important that you are aware of the rules concerning visitors when searching for a future retirement community.

I receive the aged pension, what Government Benefits am I eligible to claim?

Contact Centerlink

Centrelink is the best Government Agency to provide you with this information and advice about what assistance you are eligible to claim.

These could include:

– Rent Assistance
– Low Income Household Rebate for Electricity
– Low Income Energy Rebate For Gas including LPG

It is currently stated on the Services Australia Government website that if you receive the Age Pension and meet certain other requirements including paying recurrent charges to a retirement village operator you can be eligible to receive Rent Assistance.

This applies to both Self Care or Independent Living Units and A Serviced Unit or Apartment.

Some of the eligibility criteria taken into consideration are:

– The price you paid for the unit must be below a threshold value. If it is above the stated threshold, you are considered the home owner and may not eligible for rent assistance (sounds very confusing so talk to Centrelink)
– You must be paying rent to a retirement village operator
– You must be living in Australia and meet the rules concerning residency
– You must pass the Assets Test.

You will not be eligible for rent assistance if:

– You are paying rent to a government housing authority
– The price you paid for the unit must be below a threshold value
– You already own the home you live in
– You are not currently living in Australia
– You already live in a retirement facility that receives government funding
– You are paying a rental amount that is less than the threshold
– You or your partner has a dependant under the age of 16
– You are already receiving an incentive allowance for Centrelink.

Remember, the best place to obtain accurate and current information concerning your eligibility is Centrelink. I have always advised residents to discuss their personal situation and circumstance with the staff at Centrelink. Their website has lots of useful information.

Low Income Household Rebate

In New South Wales, if you hold a Pensioner Concession Card, you may be able to apply for the Low Income Household Rebate if you meet the eligibility requirements.

The Rebate is currently worth a total of $285.00 per year.

Residents of a retirement village who are billed either directly by the energy provider or by the village operator can apply. You just need to ensure you complete the correct application form.

It is easy to apply for either online or by post.

Low Income Household Rebate – Gas Including LPG

You may also be eligible for rebates on your gas, both natural gas and bottled LPG. In New South Wales this can be as much as $121.00 and it will be deposited into your bank account.

Rental Arrangements

Yes, there are a number of villages that offer rental units in retirement communities for residents for are not able to purchase a unit. Some also offer a rent before you buy option to enable you to assess if buying and living in a retirement village is for you.

There are some retirement villages that provide exclusively rental units whilst other villages may have both rental and owner occupied units.

If a village does offer rental options the arrangement will be the same as that of a private rental agreement. This means that you will need sign a Lease or Tenancy Agreement and provide a rental bond or deposit. You will be bound by the legislation governing residential tenancy. You will also need to follow the Village rules and policy and procedures.

Your unit may or may not be metered individually for water and electricity . Your lease will state this so you can determine if you will be responsible for paying for thee utilities.

But unlike most retirement tenure types, you will not be required to pay an exit fee when you leave the property.

This makes it ideal for people who don’t have the financial means to buy a retirement property while still offering them a place in an over 55s living community.

Leasehold Arrangement

In this type of occupancy, the village operator actually owns the units. Each resident enters into a lease, which typically runs for a minimum of 99 years, but can range anywhere between 49 and 199 years.

The leases are registered on the title deed (held by the Land Registry Services). If your lease is over 50 years you are considered a ‘registered interest holder’. You’re considered a non-registered interest holder if your lease is below 50 years.

You may still have some associated costs such as paying the operator a share of the capital gains; departure or exit fees or other charges. The ‘other’ charges will be deducted from your exit entitlement.

Licence to Occupy or Loan Arrangements

This is the most common type of tenure used by “not-for-profit” developers, churches, or charities. The developer or operator provides a license for you to occupy a unit. You pay an incoming contribution which is usually in the form of an interest-free loan.

You are allowed to live in a unit, but you do not own it, and it also carries certain conditions, such as not allowing changes to the property or garden. You pay recurrent monthly fees for services and facilities. When you leave the property a donation fee is subtracted from your refund amount.
